【摘要】:1.1ThisguidecoversaframeworkforemployinggoodcommercialandcustomarypracticesinconductingaPhaseIIenvironmentalsiteassessment(ESA)ofaparcelofcommercialpropertywithrespecttothepotentialpresenceofarangeofcontaminantswhicharewithinthescopeofCERCLAaswellaspetroleumproducts.1.1.1ThisguideisintendedtoprovidepracticalproceduralguidanceforthecontinuationofanassessmentconductedinaccordancewiththemostrecenteditionofPracticeE1527orE1528,orboth.PracticeE1527isthepracticeforconductingPhaseIESAsforaparcelofcommercialpropertyandPracticeE1528isthetransactionscreenpractice.Bothpracticesdefineaprocessthatisintendedtoconstitute"allappropriateinquiryintothepreviousownershipandusesofaproperty"todeterminewhetherhazardoussubstancesorpetroleumproductshavebeendisposedorreleasedthereinordertosatisfyoneelementoftheinnocentpurchaserdefensetoCERCLAliability.1.1.2BecausethisguideforconductingPhaseIIESAsdescribesaprocessforfurtherevaluatingaparcelofcommercialpropertywithrecognizedenvironmentalconditions,asdefinedinPracticesE1527andE1528,usersofthisguideshouldunderstandtherequirementsandlimitationsofthosepractices.ItisstronglyrecommendedthattheuserrefertoandapplytheguideinconcertwithPracticesE1527andE1528.1.1.3Thisguidehasmultiplepurposes.ItisintendedtoprovideassistancetousersinsatisfyingtheappropriateinquiryelementofCERCLA''sinnocentpurchaserdefense,asdefinedin42U.S.C.167;9601(35)(B),whereapreviousassessmentsatisfyingthatelementidentifiedrecognizedenvironmentalconditions.Thisguidealsoisintendedtoassistauseringatheringreliableinformationaboutaproperty''senvironmentalconditionstoguidetheuser''sbusinessdecisions.However,thisguidedoesnotpurporttoincludethelevelofspecificityrequiredoftechnicalstandardsthatgovernfullcharacterizationofasite''senvironmentalconditions.1.2Objectives8212;TheprimaryobjectivesofconductingaPhaseIIESAaretoevaluatetherecognizedenvironmentalconditionsidentifiedinthePhaseIESAortransactionscreenprocessforthepurposeofprovidingsufficientinformationregardingthenatureandextentofcontaminationtoassistinmakinginformedbusinessdecisionsabouttheproperty;andwhereapplicable,providingthelevelofknowledgenecessarytosatisfytheinnocentpurchaserdefenseunderCERCLA.1.2.1Toachievetheseobjectives,itmaybeappropriatetoperformmorethanasingleiterationofassessment.TheguidefostersaniterativeapproachtoPhaseIIassessmentsandallowstheusertoterminatethePhaseIIESAatthepointwheresufficientdatahavebeengeneratedtomeettheuser''sobjectives.1.2.2AtthecompletionofaPhaseIIESA,theenvironmentalprofessionalshouldbeabletoconclude,ataminimum,thateither(a)theESAhasprovidedsufficientinformationtorenderaprofessionalopinionthatthereisnoreasonablebasistosuspectthepresenceofhazardoussubstancesorpetroleumproductsatthepropertyassociatedwiththerecognizedenvironmentalconditionsunderassessment,or(b)theESAhasconfirmedthepresenceofhazardoussubstancesorpetroleumproductsatthepropertyunderconditionsthatindicatedisposalorrelease.IftheinformationdevelopedintheESAisinsufficientfortheenvironmentalprofessionaltoreacheitheroftheseconclusions,theenvironmentalprofessionalmayrecommendadditionaliterationsofassessmentifwarrantedtomeettheobjectivesoftheuser.Iftheenvironmentalprofessionalreasonablysuspectsthatunconfirmedhazardoussubstanceorpetroleumreleasesremainbutconcludesthatfurtherreasonableassessmentisnotexpectedtoprovideadditionalinformationofsignificant......

【摘要】:ThesecurityframeworksaddresstheapplicationofsecurityservicesinanOpenSystemsenvironment,wherethetermOpenSystemsistakentoincludeareassuchasDatabase,DistributedApplications,ODPandOSI.Thesecurityframeworksareconcernedwithdefiningthemeansofprovidingprotectionforsystemsandobjectswithinsystems,andwiththeinteractionsbetweensystems.Thesecurityframeworksarenotconcernedwiththemethodologyforconstructingsystemsormechanisms.Thesecurityframeworksaddressbothdataelementsandsequencesofoperations(butnotprotocolelements)whichareusedtoobtainspecificsecurityservices.Thesesecurityservicesmayapplytothecommunicatingentitiesofsystemsaswellastodataexchangedbetweensystems,andtodatamanagedbysystems.Thesecurityframeworksprovidethebasisforfurtherstandardization,providingconsistentterminologyanddefinitionsofgenericabstractserviceinterfacesforspecificsecurityrequirements.Theyalsocategorizethemechanismsthatcanbeusedtoachievethoserequirements.Onesecurityservicefrequentlydependsonothersecurityservices,makingitdifficulttoisolateonepartofsecurityfromtheothers.Thesecurityframeworksaddressparticularsecurityservices,describetherangeofmechanismsthatcanbeusedtoprovidethesecurityservices,andidentifyinterdependanciesbetweentheservicesandthemechanisms.Thedescriptionofthesemechanismsmayinvolvearelianceonadifferentsecurityservice,anditisinthiswaythatthesecurityframeworksdescribetherelianceofonesecurityserviceonanother.Thispartofthesecurityframeworks:-describestheorganizationofthesecurityframeworks;definessecurityconceptswhicharerequiredinmorethanonepartofthesecurityframeworks;-describestheinter-relationshipoftheservicesandmechanismsidentifiedinotherpartsofmeframeworks.
